Terms of service.

Any service work performed will be billed according to the following:

  • The minimum charge for any service call is $125.

  • Standard business hours are 8am-4pm Monday-Friday.

  • After hours business hours are 4pm-8am Monday-Friday. All hours on Saturday and Sunday are considered after hours.

  • Standard labor rates are defined as $125 for the first hour for a lead electrician; additional hours are $110/hour billed in quarter-hour increments. Apprentice electricians are billed at $75/hour in quarter-hour increments. The clock starts when the electrician(s) leaves for your jobsite. The clock ends when the electrian(s) completes their work notes and the invoice is created.

  • After hours labor rates are defined as $187.5 for the first hour for a lead electrician; additional hours are $165/hour billed in quarter-hour increments. Apprentice electricians are billed at $112.5 in quarter-hour increments.

  • Time estimations may be provided as a courtesy, but are not binding agreements.

  • If a electrician requires more time to complete the scope of work than anticipated, you may ask them to stop and be billed for the time spent prior to the stop request.

  • You may also request a quote in replacement of an estimation which has binding terms which are outlined in said quote.

  • Material is billed for what is used at a jobsite. Prices are non-negotiable on all items.

  • Payment is due at the completion of the work unless otherwise stipulated in writing.

  • A 3.5% fee will be added to any bill over the amount of $2,000.00 that is paid via credit card.

  • Customer signature is defined as verbal over Toussaint Electric’s recorded telephone line, written over email to any email operated by Toussaint Electric or it’s affiliated organizations, a signed paper quote, or a text response regarding Toussaint Electric’s terms of service.

General Terms & Conditions:

1. If openings in the walls, ceilings, floors, or ground are required to perform any work, it will be discussed with the owner(s) prior to making said openings. Any drywall repair, spackle, or paint that is required will be the sole responsibility of the owners.

2. If trenching in the ground is required to perform any work, any pre‐existing conduits or cables that have not been properly buried, may become damaged while our crew is trenching. If such a situation occurs, it will be the sole responsibility of the owners to have any necessary repairs made. We are not responsible for billing other subcontractors.

3. If inspection is required, you will need to be present to allow the inspector access. If you are not present the inspection will not pass, and there could be a re‐inspection fee. If re‐inspection fees are required due to non‐access, customer agrees to pay.

4. A proposal is based upon the current costs of material and labor. Should the market price of materials increase by five (5) percent or more the customer agrees to pay the cost associated with such increase.

5. Proposals are valid for thirty (30) days from the proposal date.

6. If the AHJ requires additional devices or items not indicated on the plans, or not included in the specifications, they will be added at additional cost.

7. Quotes are based on working hours 8am‐3:45pm EST

8. Damage resulting from the installation of our scope of work to underground items that have not been identified by locates will not be the sole responsibility of the electrical contractor. No permit fees or utility company fees (such as FPL) are included unless otherwise noted above.

9. All work will be performed in accordance with the national electric code standards and local ordinances.  

10. If work does not commence within 30 days of the date of a proposal, or if work is delayed after the designated start date by customer, Toussaint Electric, LLC reserves the right to increase the price to the current material cost at that time.

Payment Schedule & Liability:  

Customer signature is defined as verbal over Toussaint Electric’s recorded telephone line, written over email to any email operated by Toussaint Electric or it’s affiliated organizations, a signed paper quote, or a text response regarding Toussaint Electric’s terms of service. Customer signature signifies authorization of quoted work and acceptance of payment liability. Payment is due upon completion of work or satisfactory passing of any required inspection or as otherwise outlined in the quote. If the invoice is not paid and Toussaint Electric engages an attorney to enforce collection, and the customer agrees to pay all expenses including court costs and reasonable attorney fees to be fixed by any court in which said attorney is required to appear. The customer further agrees that he or she may be sued in an Indian River County, Florida court. The payment for material and labor provided under this contract shall be due and payable in full on the provided due date of each invoice and shall be made at our office in Vero Beach, Florida. Interest at the rate of 1.5% per month (18% annually) shall be charged for any amount not paid within 20 days. Any litigation arising out of this contract the prevailing party shall be entitled to recover reasonable attorney fees and costs including appellate proceedings. If judicial proceedings are necessary to enforce the terms of this contract, venue shall be in a State of Florida court of competent jurisdiction in Indian River County, Florida.
